When you rent from us at Moonbeams and Memories, you agree to these terms and conditions.

 

Payment Policy:

Your party will be confirmed once your $100 non-refundable deposit is received, through Venmo. Your balance is due in full 7 days before your party date. If balance is not paid, you will be subject to party cancellation. 

 

Damage Policy:

No children age 2 or under should be on our beds or in the teepees at any time for safety. Our set up is best designed for ages 5 and up. Prohibited items as described but not limited to animals such as dogs or cats in set up area, shoes, slime, fingernail polish, staining foods or drinks, (pizza, chocolate sauce, pop, juice, etc.) make up, blood, etc. Any stains inside or outside the teepee or on any other items may result in partial or complete loss of damage deposit. Excessive cleaning needs as determined by Moonbeams and Memories staff may result in loss of part or all of your damage deposit. Please keep the tent set up in an environment clean and smoke-free.  If all rental items are not accounted for at pickup, the renter is liable for all costs and fees to replace said items.

Damaged items that will need to be replaced will require the following replacement fees:

Tents- $50 each

Tent Poles- $5 per pole

LED Fairy Lighting- $5 per strip

Inflatable Mattresses- $20 

Fitted Sheets- $10 

Blankets- $15

Decorative/Throw Pillows- $15

Bed Tray-$20

Lantern/neon light- $15

Rugs- $20

Air Pump- $20

Smores Maker - $40

Cotton Candy Maker - $40

Bunting, garland or other decorative accessories - $15

Excessive Cleaning Fee - $10 per item.

Cancellation Policy:

Cancellations can be made 7 days prior to the scheduled party date. The $100 deposit is non-refundable but may be applied towards the cost of another party if held within 180 days of the original party date. If you choose to cancel our services for any reason, your deposit will be forfeited.

Party Guest Policy:

If a party guest will not be able to attend & you let us know 7 days before, it is no problem. You will not be charged for that setup. If a party guest will not be able to attend & you let us know 1-6 days before your party, unfortunately we are not able to issue a refund and there are no refunds for guests that don't show up.

ADULT SUPERVISION IS REQUIRED AT ALL TIMES DURING YOUR RENTAL PERIOD

TERMS OF SERVICE - PLEASE READ

 

Please read these Terms of Service carefully before accessing or agreeing to use our website or our services. By filling out and submitting our form, you agree to be bound by these Terms of Service. 

This website is operated by Moonbeams and Memories. Throughout the site, the terms “we”, “us” and “our” refer to Moonbeams and Memories. We offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or engaging in our “Service”, you agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

By accepting and using the rental items, the client (person(s) listed on the event agreement), for itself and all other persons that may use the rental items (including, but not limited to any of client's family or guests of the client in their home ), specifically acknowledges that each such item is being rented and used at the own risk of renter and such other persons.  Accordingly, the client, for itself and on behalf of all such other persons, to the maximum extent permitted under applicable law, hereby releases the Company and its owners, officers, employees, contractors and representatives (collectively, Moonbeams and Memories, aka M&M) from any claims, damages, risks, losses, costs, expenses, injuries or death that may result from any use of any rented items, whether the client, the children of client (and/or the guests of client that use any of the rented items), including but not limited to any damages to property and/or client’s home, which in any way is associated with or caused by any rental items rented by client.  Without limiting the generality of the foregoing, the client acknowledges and agrees that none of the M&M will be liable, obligated or responsible for accidents, injuries or property damage directly or indirectly caused or incurred by the use (or misuse) of any person of any rental items rented by M&M.  The client agrees to indemnify, defend and hold harmless each of the M&M affiliates for, from and against any and all claims (including but not limited to claims of third parties), demands, suits, actions, causes of action, liabilities, damages, losses, costs and expenses (including, but not limited to, court costs and reasonable attorneys’ fees) which are made or asserted against, or which are incurred by, the company party, and which arises, directly or indirectly, out of this Agreement or any use by the client  or any other person (including, but not limited to any children of the client or any of client’s guests) that makes use of any rental items or which otherwise results from any act, omission, injury, accident, death or damage to property that arises from any use or rental of any items rented to the client by M&M (whether or not as a result of negligence and whether or not foreseeable).

We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order if we feel that our terms and conditions are not being met or if we determine that the environment is not suitable for our equipment. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

Third party liability

Children must be supervised at all times by an adult (18) years or older during the rental period. Moonbeams and Memories will not be liable for any personal injury, death, loss, or damage to property however caused during your rental period. The client is responsible for any accidents that occur during the rental period. If you have any safety concerns regarding our equipment, please let us know prior to departure after set up so we can modify or remove items if needed.

Insurance

Insurance is the client's responsibility during the rental time period and the client maintains that he/she has coverage and is up to date with all payments regarding hazard insurance. Moonbeams and Memories is not liable for any accidents that occur during the rental period. The client accepts all responsibility and is responsible for the security of the rental items at all times during the rental period. The client will be responsible for any damaged items.
